1. PRODUCTS OFFERED. PURCHASE SYSTEM.
1.1. The products offered in the ONLINE Store, as well as their characteristics and sale prices, will be configured as advertised in it. Likewise, the shipping costs to the user's address will be reported, which will always be paid by the customer. The prices indicated include VAT, although they will be subject to the taxes that apply to them in their case, according to the information provided by the user and they will be the current prices at all times, except for typographical errors. JAVIER ZARZUELA reserves the right to modify the products contained and offered through the ONLINE Store without prior notice. Thus, new products may be added or discontinued without prior notice.
1.1.1 Products in Stock - 100% payment
1.1.2 Pre-Order Products - 50% non-refundable payment for being ordered, 50% at the end of the production of the order, an email will be sent to proceed with the remaining payment of the product and shipping costs.
1.2. For the acquisition of products in the ONLINE Store, users will be asked to proceed to register, for which said users, who must be of legal age, must fill in the boxes according to the instructions that appear on the screen. The user is reminded that he is responsible for the veracity of the data entered.
1.3. Once the user has registered, and to proceed with the purchase in the ONLINE Store, they must add the product they wish to purchase in the "shopping cart", completing for this purpose the supplied order form and sending it to the ONLINE Store, which implies the reading and irrevocable acceptance of each and every one of these General Conditions, as well as, where appropriate, the existing Particular Conditions. The purchase shall be understood to be made at the address of the ONLINE Store.
1.4. Once the purchase has been made and in the shortest possible time, JAVIER ZARZUELA will send the user a proof of purchase by email. The invoice will be sent together with the order to the address provided. The order confirmation and proof of purchase will not be valid as an invoice. The purchase prices will be those in force at the time the order is placed. Shipping costs will be calculated automatically based on the shipping address provided by the customer, the weight of the order and the amount of the purchase.
1.5. JAVIER ZARZUELA reserves the right to cancel access to the Store for those users who maintain debit or unpaid balances with JAVIER ZARZUELA.
2.SHIPPING
2.1. For shipments to the provinces of the Balearic Islands, Ceuta, Melilla, the Canary Islands, as well as the rest of the world, they must be made through the email info@javierzarzuela.com
2.2. For shipments of packages of more than 100kg, they must be made through the email info@javierzarzuela.com

3. FORMA DE PAGO.
3.1. The payment of the price of the purchased goods and the shipping costs will be made in accordance with the means of payment that are indicated on the Portal at any time. We guarantee that each of the transactions made is 100% secure. All operations that involve the transmission of personal or banking data are carried out using a secure environment. NICOLAS MONTENEGRO uses a server based on the standard security technology SSL (Secure Socked Layer). All the information that you transmit to us travels encrypted through the network. Currently the payment methods available are:
Credit card: VISA, AMEX, MASTERCARD
Bank transfer: If you choose this option, we will provide you with our bank details and the details of your purchase so that you can make a deposit or bank transfer. Once the payment has been made, so that we can verify it quickly, you can send us a bank receipt by email to info@nicolasmontenegro.com. Please indicate the order number in the comments of the transfer. The shipment of the order will be made as soon as we verify the income.
4. RETURNS AND RIGHT OF WITHDRAWAL.
PRE-ORDER PRODUCT : as it is a custom product, there are no returns or exchanges. If before the 20 days of production and shipping you reject the final payment, the preorder payment will not be refunded.
PRODUCT MANUFACTURED IN STOCK: The client will have a period of fourteen (14) calendar days to resolve the sale, provided that the nature of the purchased good allows it. This period will be computed from the receipt by the customer of the purchased goods. It will be understood that the client has been aware of the right of withdrawal from entering the Store, which requires reading and acceptance of these General Conditions, and in any case from the moment the order is placed. This right of withdrawal will not apply to those personalized products or those that for reasons of hygiene or other legally contemplated exceptions are not subject to withdrawal.
Returns of orders must be sent to the address JAVIER ZARZUELA. Exercised by the customer the right of termination, JAVIER ZARZUELA will return the amounts received by credit, discounting €20 management. Return costs will be paid by the customer.
To make a return you must take into account the following:
a) To make a return to JAVIER ZARZUELA, this must be done within 14 days after the date of receipt of the same. Return costs will be borne by the customer.
b) The product to be returned must be in its original state, with its label, packaging and without having been used or manipulated. No smells, no makeup.
c) Be sure to read the product specifications in detail before placing your order and to check the correct condition of the supplied product before signing the delivery note. In case of doubt, contact us.
d) Shipping costs are paid by the customer unless it is a defective product, or error on our part.
e) In case of refund of the amount, the client will be charged €20 for management and administrative expenses, unless the legislation on the defense of consumers and users is applicable.
f) We are not responsible for shipments confiscated by Customs or other similar entities. Contact the Organizations of your country or area to expand the information on the product you want to purchase, in case of doubt.
g) All returns must be previously authorized by JAVIER ZARZUELA. To do this, send us an email indicating the reasons for the return and we will send you an authorization code as soon as possible that you must keep in the package. Once the package is received, we will confirm by email if the return has been accepted or rejected.
h) In case of stock out, JAVIER ZARZUELA undertakes to inform the customer and make the refund of the amounts as quickly as possible.
5. WARRANTY.
JAVIER ZARZUELA guarantees the product under the legally established terms. The total responsibility of JAVIER ZARZUELA for any concept, will not exceed, in any case, the total value of the defective merchandise supplied. Deficiencies caused by negligence, blows, improper use or manipulation, improper tension, incorrect installation, or materials subjected to wear due to normal use are not included.
6. TAXES.
The purchase system is subject to the legislation in force in Spain, therefore, sales operations will be understood to be carried out at the registered office of JAVIER ZARZUELA c/ Mariano Benlliure, 846016 Tabernes Blanques, Residents in the European Union. The prices of the products that are for sale and their corresponding shipping costs are subject to Value Added Tax (VAT). If there is any additional tax to deliver the order, it will be borne by the buyer.
7. APPLICABLE LAW. SUBMISSION TO JURISDICTION.
7.1. This contract will be governed by Spanish legislation, which will be applicable to what is not provided in this contract in terms of interpretation, validity and execution.
7.2. The parties expressly waive the jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of Valencia to resolve any dispute that may arise in the interpretation or execution of these contractual conditions.
